CAN YOU BELIEVE THE BIBLE LAYS THE FOUNDATION FOR AMERICAN BANKRUPTCY LAW AND GIVING EVERYONE A SECOND CHANCE?

On Behalf of | Sep 20, 2022 | bankruptcy

Several people we have come in contact with over the last 37 years feel incredible guilt about filing bankruptcy even when their debt came from unforeseen circumstances in which they had no control.  For example, if anything is an unforeseen circumstance, it is the COVID 19 pandemic.

When we look at verses in the Bible, it should be obvious that there should be no guilt associated with filing bankruptcy.

In the book of Deuteronomy, Chapter 15 starts off as follows:

“1. At the end of seven years, you shall institute a remission: every creditor shall not press his fellow or his brother…”

The book of Deuteronomy continues with language about showing compassion for a debtor.

The following language is in Chapter 24:

“10.  When you shall claim a debt of any amount from your fellow, you shall not enter his house to take security for it.

11.  You shall stand outside; and the man from whom you claim shall bring the security to you outside.

12.  If that man is poor, you shall not sleep with his security.

13.  You shall return the security to him when the sun sets. . .”

In addition, the Bible has numerous instances where we are all forgiven for our sins and given another chance.

A couple of examples appears in the book of Numbers and Exodus. In the book of Numbers when spies slandered the land that was promised to the Israelites, the nation of Israel was punished but the judgment was tempered with mercy.  Numbers, Chapter 14, Verse 20.

Also, in the book of Exodus when the Israelites made a mistake in calculating when Moses would come back and built the golden calf, Chapter 32 Verse 33 of the book of Exodus shows that the Lord had mercy on the Israelites and gave them another chance.

One will notice that not only religion, but American society gives all of us a second chance in life for errors that we have made.

The overwhelming majority of people who file bankruptcy don’t plan not to pay their bills.  The major reasons for bankruptcy are illness, loss of employment or divorce.

In addition, most clients we have represented over the last 37 years have made every effort to pay their bills and have used all their savings before bankruptcy was the last alternative.
